1. About This Site and These Terms
This website (mindfulsolutionstherapynv.com) is operated by Mindful Solutions Therapy LLC ("we," "us," "our"), a Nevada limited liability company owned and operated by Robyn Mendiola, LCSW, MSW (Nevada License #6452-C). "You" means the person accessing or using the site. These Terms of Use ("Terms") are a legally binding agreement between you and us.
The site is intended to provide general information about our therapy services in Nevada and educational content on mental-health topics. The site is directed to and intended for adults (18+) in the United States, with a primary audience of residents of Nevada.
2. Acceptance of Terms
By accessing, browsing, or otherwise using this site — including submitting a contact form, viewing a blog post, or clicking through to Alma from our scheduling links — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Educational and Informational Use Only
Content on this website — including pages, blog posts, resource links, FAQs, downloads, and any other material — is provided for general educational and informational purposes only. It is not medical advice, not mental-health advice, not therapy, not diagnosis, and not treatment. It does not replace consultation with a qualified, licensed clinician who knows your individual history.
Reading this site, browsing our blog, or sending a message through our contact form does not create a therapist-client relationship, a physician-patient relationship, or any other professional relationship between you and Robyn Mendiola, LCSW or Mindful Solutions Therapy LLC.
4. How a Therapist-Client Relationship Is Actually Formed
A therapist-client relationship with Robyn Mendiola, LCSW is established only after all of the following have occurred:
- You have completed and signed our informed consent and intake paperwork.
- We have confirmed eligibility (including that you are physically located in Nevada at the time of each telehealth session, per Section 8).
- We have agreed in writing on a fee arrangement (self-pay or insurance).
- You have attended an initial scheduled session.
Up until that point, any interaction through this website, email, or phone is a prospective inquiry only.
5. Not a Substitute for Emergency or Professional Care
Do not rely on this website in place of professional medical or mental-health care. This site does not provide emergency services. We do not monitor the contact form, email, or voicemail for emergencies. If you or someone you know is in a mental-health crisis or in danger:
- Call or text 988 (Suicide & Crisis Lifeline).
- Call 911 or go to your nearest emergency room.
- Contact the Nevada Mobile Crisis Response Team at (702) 486-7865.
6. External Links and Third-Party Content
This site links to third-party websites and resources (for example, on the Resources page, in blog content syndicated from external feeds like Substack, and in vendor links such as Alma). We provide these links as a convenience only. We do not endorse, control, or assume responsibility for the content, accuracy, privacy practices, safety, or availability of any linked site. Accessing third-party sites is at your own risk and is subject to those sites' own terms and policies. Links do not imply any affiliation, sponsorship, or partnership unless explicitly stated.
7. Contact Form, Email, and Communications
Messages submitted through the contact form are processed by a third-party form provider (FormSubmit.co) and delivered to our standard Gmail inbox. Email is not a secure, HIPAA-compliant medium and this form does not meet HIPAA's end-to-end encryption and Business Associate Agreement requirements.
Do not send protected health information (PHI), detailed clinical history, diagnoses, medications, or other sensitive material through the contact form or unencrypted email. Save those for your first session, where communications are protected under HIPAA. By checking the acknowledgment box on the contact form, you confirm you have read and accept this limitation.
We reserve the right, but have no obligation, to respond to any inquiry. Receipt of an inquiry does not guarantee availability, appointment acceptance, or insurance-network fit.
8. Telehealth Services Limited to Nevada
Intake paperwork requires you to confirm your Nevada address and your physical location at session time. Providing false location information may result in immediate termination of services.
9. Intellectual Property
Unless otherwise noted, all content on this website — including text, graphics, logos, icons, images, photographs, page layouts, source code, and the "Mindful Solutions" and "Mindful Solutions Therapy" names and marks — is the property of Mindful Solutions Therapy LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws.
You may: view, print, and download a reasonable number of pages for your own personal, non-commercial use only.
You may not: copy, reproduce, republish, scrape, mirror, distribute, sell, lease, sublicense, modify, translate, or create derivative works of any part of the site; remove copyright or other proprietary notices; use our name, logo, or likeness of Robyn Mendiola in any advertising or publication; or use the content to train machine-learning models — all without our prior written permission.
Third-party content displayed on this site (including blog content syndicated from Substack and resource links) remains the property of its respective owners and is shown subject to those owners' terms.
10. User-Submitted Content and Testimonials
We do not currently publish user-generated content, reviews, or testimonials on this site. If we ever do — for example, a future testimonials page — we will only publish content with the individual's written consent and in compliance with applicable professional-ethics rules (including NASW and Nevada Board of Examiners for Social Workers rules regarding solicitation of testimonials from current clients). By submitting content to us, you grant us a non-exclusive, royalty-free, worldwide license to use that content for the stated purpose. You represent that the content is your own and does not infringe anyone else's rights.
11. Acceptable Use
You agree not to:
- Use the site for any unlawful purpose or in violation of any applicable law or regulation.
- Attempt to gain unauthorized access to any part of the site, any related system, any server, or any account.
- Interfere with, disrupt, probe, or scrape the site in ways that impair its operation or security.
- Submit false, misleading, or impersonating information through the contact form or by email.
- Upload or transmit malware, viruses, worms, or any other harmful code.
- Harvest or collect information about other users (there are no other users — but just in case).
- Use automated tools (bots, scrapers, crawlers beyond standard search-engine indexing) without our written permission.
- Use the site or its content to train, fine-tune, or evaluate machine-learning models without our written permission.
- Frame, mirror, or embed the site within another site without our written permission.
12. Disclaimer of Warranties ("As Is")
The website and all content are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, title, accuracy, completeness, quiet enjoyment, and uninterrupted availability.
We do not warrant that the site will be error-free, secure, free of viruses, or continuously available; that any information on the site is accurate, current, or complete; or that any defect will be corrected. Any reliance you place on the content is strictly at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law, in no event shall Mindful Solutions Therapy LLC, its owner, members, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, data, goodwill, use, or other intangible losses, arising out of or related to:
- Your access to, use of, or inability to access or use the site;
- Any content on the site, including errors or omissions;
- Any third-party content, websites, or services linked from the site;
- Any unauthorized access to or alteration of your transmissions or data;
- Any other matter relating to the site;
whether based on warranty, contract, tort (including negligence), statute, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Aggregate cap. Without limiting the above, our total aggregate liability to you for all claims arising out of or related to your use of the site — whatever the legal theory — is limited to the greater of one hundred U.S. dollars ($100.00) or the total amount you paid us to use this website during the twelve months preceding the claim (which, for a free informational website, is $0).
Jurisdictions that do not allow certain exclusions. Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the above exclusions and limits apply to the maximum extent permitted by law, and do not limit liability for death or personal injury caused by our gross negligence, for fraud, or for any other liability that cannot lawfully be excluded. Nothing in these Terms limits any rights or remedies you may have under Nevada law as a prospective client of a licensed clinical social worker, or under HIPAA for Protected Health Information.
14. Indemnification
You agree to indemnify, defend, and hold harmless Mindful Solutions Therapy LLC and its owner, members, employees, and contractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the site; (b) your violation of these Terms; (c) your violation of any law or of any third party's rights; or (d) any content you submit through the contact form or by email.
15. Governing Law and Venue
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or your use of the site shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction and venue of those courts and waive any objection based on forum non conveniens.
16. No Class Actions (Individual Disputes Only)
To the fullest extent permitted by law, any dispute with us must be brought on an individual basis. You agree not to participate in a class action, class arbitration, or representative proceeding against us arising out of your use of this website.
17. Severability
If any provision of these Terms is held invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
18. No Waiver
Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.
19. Termination / Right to Refuse Access
We may, at our sole discretion and without notice, suspend or terminate your access to all or part of the site, block your IP address, or refuse to respond to further communications from you, for any reason, including conduct that we believe violates these Terms or is otherwise harmful. Sections of these Terms that by their nature should survive termination (including Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, Governing Law, and this survival clause) shall survive.
20. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and increment the version number. If we make a material change, we will post a prominent notice on the site. Your continued use of the site after an update constitutes your acceptance of the revised Terms.
